Agreement to Terms

By accessing or using BayTrack Maintenance (the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service.

Description of Service

BayTrack Maintenance provides fleet and shop maintenance management software, including work orders, inspections, preventive maintenance scheduling, technician time tracking, invoicing, and reporting. The Service may evolve over time, and we may add, modify, or remove features.

Account Registration

To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service
• Upload malicious code or content
• Resell or redistribute the Service without written permission

Your Data

You retain ownership of the data you enter into the Service (“Customer Data”). We do not claim ownership rights to your Customer Data, including customer information, work orders, inspections, invoices, and asset records.

You are responsible for ensuring you have the rights and permissions necessary to upload and use Customer Data, including any personal information, images, or documents.

Support and Access

We may provide support to help troubleshoot issues and maintain service reliability. If you contact support, you authorize us to access your organization’s account and related data as needed to respond.

Service Availability

We strive to maintain high availability, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, outages, or events beyond our control. We will try to provide notice when practical.

Early Access

BayTrack Maintenance may be offered in early access. During early access, features may change and new capabilities may be added regularly. Some features may be experimental, incomplete, or adjusted based on feedback.

Billing and Fees

Some portions of the Service may be offered for free, while others may require payment now or in the future. If we introduce paid plans, we will provide pricing details and notice before charging you. Taxes may apply depending on your location.

Intellectual Property

The Service, including its software, design, and branding, is owned by BayTrack Maintenance and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service unless we give you written permission.

Feedback

If you provide feedback or suggestions about the Service, you grant us the right to use that feedback to improve the Service without obligation to you.

Disclaimers

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, BayTrack Maintenance will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, resulting from or related to your use of the Service.

Governing Law & Jurisdiction

These Terms and any dispute arising out of or relating to them, including any claim regarding the Service, shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of laws rules.

You agree that any legal action or proceeding between you and BayTrack Maintenance that arises out of or relates to these Terms shall be brought exclusively in the state or federal courts located in the State of Georgia. By using the Service, you consent to the personal jurisdiction and venue of these courts for such disputes.

Changes to Terms

We may modify these Terms from time to time. If we make material changes, we will post updated terms and revise the “Last updated” date above. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

Termination

You may terminate your account at any time. We may suspend or terminate accounts that violate these Terms or misuse the Service. Upon termination, you may request export of your data where available.
